1. Acceptance of Terms

Welcome to Braaply. These Terms and Conditions ("Terms") govern your access to and use of the Braaply website, mobile application, and all related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. The Braaply Service

Braaply is a platform for discovering, mapping, navigating, and sharing information about off-road vehicle trails. The Service is intended for informational and recreational purposes only.

3. Safety, Assumption of Risk, and Disclaimer

This is a critical notice. Please read it carefully.

Off-road riding is an inherently dangerous activity that presents serious risks of property damage, physical injury, and even death. Trail conditions can change rapidly and without notice due to weather, erosion, maintenance, or other factors.

By using the Braaply Service, you acknowledge and agree to the following:

  • You Are Solely Responsible for Your Safety: You are responsible for your own safety at all times. Always ride within your limits, use appropriate safety gear, and ensure your vehicle is in proper working condition. Never ride alone.
  • Information Is Not Guaranteed: The trail information provided through the Service, including maps, difficulty ratings, and conditions, is provided "as-is" and without any guarantee of accuracy, completeness, or safety. This information is often contributed by other users and may be outdated or incorrect.
  • Obey All Laws and Regulations: You are responsible for knowing and obeying all local, state, and federal laws, including traffic laws, land use restrictions, and vehicle regulations. Using our Service does not grant you permission to access any area.
  • Respect Private Property: You agree not to use the Service to plan or engage in trespassing on private property. Always stay on designated and legally accessible trails.
  • Assumption of Risk: YOU VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN, ASSOCIATED WITH USING THIS SERVICE AND PARTICIPATING IN OFF-ROAD ACTIVITIES.

4. Trail Status and Accessibility

Trail Status Information: Braaply provides trail status information, including whether trails are open, closed, or destroyed, based on available data and user reports. However, trail conditions can change rapidly and without notice.

  • Destroyed Trails: Trails marked as "Destroyed" indicate that the trail system has been reported as permanently damaged, inaccessible, or no longer suitable for riding. This may be due to environmental factors, private property restrictions, legal closures, or physical destruction.
  • Verification Required: Always verify current trail conditions and access permissions through official sources, local authorities, or recent on-site reconnaissance before riding.
  • User Responsibility: You are solely responsible for confirming trail accessibility and legality before riding, regardless of the status shown in the Braaply Service.
  • Reporting Changes: Users are encouraged to report accurate trail status updates to help maintain current information for the community.

5. User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

6. User-Generated Content

You may be able to create, upload, or share content, such as trail recordings, photos, and comments ("User Content"). You retain ownership of your User Content. However, by submitting User Content to the Service, you grant Braaply a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Service.

7. Paid Services and Subscriptions

The Service, or certain features of it, may be offered as a paid product, either through a one-time purchase or a recurring subscription.

  • Billing: All payments are processed through third-party platforms like the Google Play Store. Billing is subject to the terms and conditions of the respective platform.
  • Automatic Renewal: Subscriptions may automatically renew unless you cancel them before the end of the current billing period through your app store account settings.
  • Cancellations: You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing period. No refunds will be provided for the current period.

8. Acceptable Use and Prohibited Conduct

You agree not to use the Service for any unlawful purpose or to engage in any of the following prohibited activities:

  • Posting content that is defamatory, obscene, or hateful.
  • Harassing, threatening, or abusing other users.
  • Uploading false, inaccurate, or misleading trail information.
  • Using the Service to plan or engage in trespassing or any other illegal activity.
  • Attempting to disrupt or compromise the integrity or security of the Service.
  • Engaging in automated data collection, scraping, crawling, or harvesting of any content or data from the Service without express written permission.
  • Using bots, spiders, or other automated tools to access or extract data from the Service.
  • Copying, reproducing, or redistributing Braaply's data, including but not limited to trail maps, coordinates, user content, and compiled databases.
  • Reverse engineering, decompiling, or attempting to extract underlying data structures or proprietary algorithms.

9. Data Ownership and Protection

Braaply Data Ownership: All data, content, and information available through the Service, including but not limited to trail maps, GPS coordinates, route data, user-generated content, photographs, reviews, ratings, and any compiled databases or data aggregations (collectively, "Braaply Data"), are owned by or licensed to Braaply LLC. This includes both original Braaply content and user-contributed content that has been processed, organized, or enhanced through the Service.

Prohibited Data Activities: You are expressly prohibited from:

  • Systematically downloading, copying, or extracting Braaply Data through automated means
  • Creating derivative databases using Braaply Data
  • Selling, licensing, or commercially distributing any Braaply Data
  • Using scraped or extracted data to create competing services
  • Circumventing technical measures designed to prevent unauthorized access or data extraction

Limited Personal Use: You may access and use Braaply Data solely for your personal, non-commercial recreational purposes in accordance with these Terms. Any other use requires explicit written authorization from Braaply.

10. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Braaply LLC and its licensors. Our trademarks and branding may not be used in connection with any product or service without our prior written consent. All rights not expressly granted in these Terms are reserved by Braaply.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

12. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BRAAPLY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE.

IN NO EVENT SHALL BRAAPLY, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
